In short
HerChapter is an online marketplace that helps users discover and book independent professionals. HerChapter is not itself a therapy, medical, nutritional, legal or other professional-service provider. Professionals are responsible for the services they provide, their qualifications and compliance with the laws that apply to them.
1. The HerChapter service
These Terms of Service (“Terms”) govern your access to and use of HerChapter, including herchapter.site, HerChapter account areas, professional profiles, booking tools and related services (together, the “Platform”). By creating an account or using the Platform, you agree to these Terms.
HerChapter helps users find independent professionals across categories such as mental health, career, relationships, wellbeing, motherhood, personal growth and nutrition. Features may change as the Platform develops.
2. Eligibility and accounts
You must be at least 18 years old and legally able to enter into a contract to create an account or book a professional through HerChapter.
- You must provide accurate and current account information.
- You are responsible for keeping your login credentials confidential and for activity under your account.
- You must notify us promptly if you suspect unauthorised access to your account.
- You may not create an account for another person without authority to do so.
3. HerChapter is a marketplace
HerChapter provides technology that allows users to discover, compare, contact and, where available, book independent professionals. Unless expressly stated otherwise at the point of booking, the professional service itself is provided by the professional, not by HerChapter.
The professional is independently responsible for the quality, legality, suitability and delivery of her services. HerChapter does not employ professionals merely because they appear on the Platform and does not control their professional judgment.
4. Professional responsibilities
If you join as a professional, you represent and warrant that all information on your profile is truthful, current and not misleading. You are responsible for:
- holding any licence, registration, qualification, insurance or authorisation required to provide your services in each jurisdiction where you practise;
- working only with clients you are legally and professionally permitted to serve;
- complying with professional, ethical, safeguarding, confidentiality, advertising, tax and consumer-law obligations that apply to you;
- keeping your availability, pricing and profile information accurate;
- providing services with reasonable care and skill; and
- not presenting coaching or other unregulated services as regulated healthcare where that would be misleading.
HerChapter may request additional information or evidence if needed to protect users or comply with applicable law.
5. Professional profile review and approval
The standard HerChapter professional registration process does not require an identity document. Before a professional profile is published, an authorised HerChapter administrator reviews the information submitted in the profile for completeness, consistency and obvious misleading or inappropriate content.
This profile review is not a comprehensive professional due-diligence process and does not, unless explicitly stated, independently verify identity, licences, registrations, qualifications, insurance, professional standing, competence or suitability for a particular client. HerChapter may request clarification or additional supporting information in an individual case where reasonably necessary for user safety, fraud prevention, legal compliance or the integrity of the Platform.
HerChapter may approve, reject, suspend or request changes to a professional application or profile. Approval is not a guarantee of future access to the Platform and does not transfer professional responsibility from the professional to HerChapter.
HerChapter may provide automated translations of professional profile content between Polish and English for convenience. The professional remains responsible for the accuracy of the source information she submits. Automated translations may contain linguistic differences and should not be treated as a separate professional representation or credential.
6. Bookings and online sessions
Professionals set or confirm their own availability. Users are responsible for checking the session time, time zone, price, duration and professional details before confirming a booking. Confirming a booking reserves the selected session time; payment is completed separately from the user dashboard. Professionals must keep calendars reasonably up to date and honour confirmed bookings except where cancellation is reasonably necessary.
Booked online sessions currently use Jitsi as a Service (JaaS), operated by 8x8, as a third-party video-call provider. Access is issued through HerChapter for the booked participants; a separate Jitsi account is not required. A session must be paid no later than 10 minutes before its scheduled start time. The Join session control remains locked until payment is confirmed and becomes clickable at the booked start time. The professional and user are responsible for a suitable internet connection, compatible device, browser permissions for camera and microphone, and a private environment for the session. HerChapter does not record session audio or video in the current MVP.
7. Prices, payments and platform fees
Creating and maintaining a professional profile on HerChapter is free. Professionals set their own session prices. For each paid session booked through HerChapter, the HerChapter platform fee is 18% of the session price and the professional retains 82%. There is no separate signup or subscription fee for professionals.
Online session payments are processed by Stripe on behalf of HerChapter. Payment-card details are entered through Stripe-hosted Checkout and are not received in full by HerChapter application servers. Reserving a session does not charge the user immediately. The user can pay from the HerChapter dashboard and must complete payment no later than 10 minutes before the scheduled session start time. After a successful payment, HerChapter records 82% of the session price as the professional’s earnings and retains 18% as the HerChapter platform commission. The professional’s share is initially shown as pending and becomes available for payout after the booked session ends. Professionals do not need to add a bank account in order to receive bookings or accrue earnings. To withdraw available earnings, a professional must add and verify a payout bank account through HerChapter’s secure Stripe Connect payout flow. Stripe’s own terms and privacy notice apply when it processes payments or payout-account verification.
8. Cancellations, refunds and statutory rights
Any cancellation or refund rules shown at the time of booking form part of the booking terms. A professional may also have service-specific cancellation conditions, provided they are clearly disclosed and comply with applicable law.
Nothing in these Terms removes rights that a consumer cannot lawfully waive, including any applicable statutory withdrawal, refund or consumer-protection rights. Where a service is scheduled to begin during a statutory withdrawal period, additional consent or information may be required before performance begins.
9. Health, wellbeing and emergencies
HerChapter is not an emergency, crisis or medical-diagnosis service. Information on the Platform is not a substitute for emergency care or for advice from an appropriately qualified professional who understands your individual circumstances.
If you believe you or another person is in immediate danger or needs urgent medical or mental-health assistance, contact the emergency services or an appropriate local crisis service in your location.
Users should choose professionals based on their needs, location and the professional’s scope of practice. Professionals are responsible for determining whether a user falls within their competence and lawful scope of practice.
10. Profiles, reviews and user content
You retain ownership of content you submit to HerChapter. You grant HerChapter a non-exclusive, worldwide, royalty-free licence to host, reproduce, format and display that content only as reasonably necessary to operate, improve and promote the Platform and your public profile, where applicable.
Reviews must reflect genuine experiences and must not contain unlawful, threatening, discriminatory, defamatory, misleading or privacy-invasive material. HerChapter may moderate, remove or restrict content where reasonably necessary to enforce these Terms or applicable law.
11. Acceptable use
You must not use HerChapter to:
- impersonate another person or provide false identity information;
- harass, exploit, discriminate against or threaten others;
- upload malware or interfere with the Platform’s security or availability;
- scrape, harvest or misuse personal information;
- circumvent account restrictions or payment mechanisms;
- promote unlawful services or misleading professional claims; or
- use the Platform in a way that violates applicable law or third-party rights.
12. HerChapter intellectual property
The HerChapter name, logo, interface, software, original copy, graphics and other Platform materials are owned by or licensed to HerChapter and are protected by intellectual-property laws. Except for normal use of the Platform, you may not copy, modify, distribute, reverse engineer or commercially exploit them without permission.
13. Suspension and termination
You may stop using HerChapter at any time. We may suspend or terminate an account where we reasonably believe there has been a breach of these Terms, fraud, a safety risk, unlawful activity, repeated complaints, misuse of the Platform or a legal requirement to do so.
Where appropriate and legally required, we will provide reasons and an opportunity to contest a moderation or account decision.
14. Third-party services
The Platform relies on third parties for hosting, authentication, transactional email and, for booked online sessions, Jitsi as a Service (JaaS) video calls operated by 8x8. Calendar and payment providers may also be used when those features are enabled. Those services may have their own terms and privacy notices. HerChapter is not responsible for third-party services outside our reasonable control, although we select providers with regard to security and operational needs.
15. Disclaimers
We aim to keep HerChapter available, accurate and secure, but the Platform may occasionally be unavailable or contain errors. To the maximum extent permitted by law, the Platform is provided on an “as available” basis.
HerChapter does not guarantee that a particular professional will be suitable for a particular user, that a professional will achieve a particular outcome, or that availability will always remain unchanged.
16. Liability
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for fraud, fraudulent misrepresentation, or death or personal injury caused by negligence where applicable law prohibits exclusion.
Subject to those mandatory rights, HerChapter is not responsible for the independent professional judgment, acts or omissions of professionals, or for losses caused by information a user or professional provides inaccurately. Any limitation of liability will be applied only to the extent permitted by the law that applies to you.
17. Changes to the Platform or these Terms
We may update these Terms when the Platform, our business model or applicable law changes. If a change materially affects your rights, we will provide reasonable notice where required. The “Last updated” date at the top of this page shows the current version.
18. Governing law and disputes
These Terms are governed by Polish law, subject to any mandatory consumer protections that apply in your country of residence. Nothing in these Terms deprives a consumer of rights or court protections that cannot lawfully be waived.
